1. General Sales Agreement : The following clauses constitute the sales contract between KITS DISCOUNT, the Vendor of products catalogued on the web site www.kits-discount.com, and the Buyer purchasing on this web site.

2. Orders :

All orders made on the present web site imply full acceptance on the part of the Buyer of the following conditions. The General Sales Agreement fully stipulates the rights of the parties to the exclusion of any other additional element.

The present contract is established by the General Sales Agreement and, subsequently in legal order, the order form.

The orders placed electronically by intermediary of "kits-discount.com" are binding from the moment that the Buyer presses the button "PAYMENT CONFIRMATION" on the order form.

All information automatically registered by "kits-discount.com" constitute the proof of the nature, the content and the date of order. By clicking on the button "PAYMENT CONFIRMATION" the Buyer indicates his firm intention to purchase the goods presented as well as his acceptation of the present General Sales Agreement.

No order will be processed without either an international money order or a valid credit card number attached.

We do not accept payment by bank card below 15 euro.

In the eventuality that one or more articles are not in stock, we order the article(s) from our suppliers and wait for the order to be complete before shipping in order to reduce the shipping costs for the Buyer, unless otherwise stipulated by the Buyer.

Should the unavailable article(s) be no longer available by the supplier, the Buyer will be charged on his credit card only the article(s) sent.

Should the payment be by money order the Buyer will receive a credit for the unavailable article(s). KITS DISCOUNT reserves the right to refuse any order from a Buyer with whom there is any legal problem.

The Buyer accepts that the photos representing a product presented on the web site www.kits-discount.com are simply an indication of the article and that due to the quality of the image presented on the Buyer's computer screen the perception of the article may vary.

3. Delivery :

Eventual delays do not authorize the Buyer to demand damages or interest.

We deliver to the delivery address furnished on the order form by the Buyer, even if different from the billing address. The information furnished by the Buyer at the moment of the order are at his fill responsibility. In case of error on the delivery address furnished by the Buyer, KITS DISCOUNT can not be held liable for failure to deliver the order.

Our deliveries are made in Europe through the French post office "La Poste" as colissimo packages with proof of receipt (the receiver's signature validates the delivery). For other countries as well as the French territories we send the packages by registered mail, either surface or air as chosen by the Buyer. Should the Buyer request non registered shipping it will be at the Buyer's own risk.

Should the Buyer refuse delivery or not claim the package, he remains liable for payment of the products delivered. In case of litigation at the moment of delivery, the receiver must note his remarks to the shipper on the shipping receipt. The litigation must be declared to KITS DISCOUNT within 48 hours.

4. Modification of the order :

The order can not be cancelled 24 hours after the date of reception of the order confirmation. Its acceptance can not be questioned.

5. Return policy :

In compliance with the law, the Buyer has 7 DAYS from the date of delivery to return the merchandise in perfect condition in it's original packaging, at his own costs. He will be fully reimbursed within 30 days. No return postage due will be accepted. The Buyer can also chose to exchange the merchandise.

6. Price :

Our prices are quoted in Euros, taxes included.

These countries are in the EU and will be charged the EU price. Belgium, Germany, France, Italy, Luxembourg, Netherlands, Denmark, Ireland, United Kingdom (England, Scotland, Wales and Northern Ireland),Greece,Spain,Portugal,Austria,Finland,and,Sweden.

Customers in countries not listed above charged the lower EXPORT price.
Our billing is based on the price quoted at the moment of the order.

7. Payment :

The Buyer chooses the method of payment among those proposed on the order form :

A. On-line payment by credit card : CB - CB Visa - Mastercard. The payment is thus processed by KITS DISCOUNT.

In case of credit card payment, the payment can be revoked in case of fraudulent use of the credit card, in compliance with the banking terms established with the Buyer and his bank.

Kits-discount.com uses secure on-line payment methods, these methods being approved by current laws. IN ANY CASE, KITS DISCOUNT DOES NOT HAVE ACCESS TO ANY INFORMATION CONCERNING YOUR CREDIT CARD.

B. International money order : the money order is cashed upon receipt and the order shipped once completed.

8 . Responsibility / Claims :

KITS DISCOUNT is responsible for the contents of the offers at kits-discount.com, the commitments announced, customer service, and delivery logistics.

The order forms are archived by KITS DISCOUNT and will be considered proof of the order both in nature and date. All claims relative to the execution of the contract must be addressed to KITS DISCOUNT by registered mail with proof of reception.

9. Proof of Transaction :

The information registered by KITS DISCOUNT constitute proof of all commercial transactions conducted by KITS DISCOUNT and their Buyers.

10. Litigation :

In case of any litigation that may arise as a result of the present contract, both parties are engaged to try to reach a friendly agreement before attempting legal action. In case of litigation the Court of Draguignan rules.
